Terms & Conditions
These Terms & Conditions (“Terms”) govern your access to and use of PixGen AI Photo Editor and related website pages (the “Service”). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
PixGen provides AI-assisted and local photo editing tools, including enhance, restore, retouch, object removal, background tools, portraits, filters, and basic adjustments. Features may change, improve, or be discontinued over time.
2. Eligibility
You must be able to form a binding contract under the laws of your jurisdiction and meet any minimum age requirements that apply where you live. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
3. Your content and license
You retain ownership of photos and text you submit (“User Content”). You grant us a limited, worldwide, non-exclusive license to host, transmit, process, and display User Content solely as needed to provide the AI and editing features you request, operate the Service, and improve reliability and safety.
You represent that you have all rights necessary to submit User Content and that your use will not infringe others’ rights or violate law.
4. Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, deceptive, or abusive purposes.
- Upload content you do not have rights to process, including others’ photos without permission.
- Attempt to reverse engineer, disrupt, overload, or gain unauthorized access to the Service or related systems.
- Use AI outputs to violate privacy, impersonate others in a harmful way, or create illegal material.
- Misrepresent the Service’s output as unaltered factual evidence when it has been AI-modified.
5. AI outputs
AI results are probabilistic. Outputs may be inaccurate, unexpected, or imperfect. You are responsible for reviewing results before sharing or relying on them. We do not guarantee that any particular edit will meet your expectations or be suitable for a specific purpose.
6. Intellectual property
The Service, including branding, design, software, and documentation, is owned by PixGen or its licensors and is protected by intellectual property laws. These Terms do not transfer ownership of our IP to you. Feedback you provide may be used freely to improve the Service without obligation.
7. Third-party services
The Service may rely on third-party infrastructure and AI providers. Your use of those components is subject to their availability and applicable policies. We are not responsible for outages or changes outside our reasonable control.
8. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIXGEN AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR FIFTY US DOLLARS (US $50).
10. Indemnity
You agree to defend and indemnify PixGen and its affiliates against claims arising from your User Content, your misuse of the Service, or your violation of these Terms or applicable law.
11. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, create risk or legal exposure, or if we discontinue the Service. Provisions that by nature should survive will survive termination.
12. Changes to the Terms
We may update these Terms periodically. The “Last updated” date will reflect changes. Continued use after updates constitutes acceptance of the revised Terms.
13. Governing law
These Terms are governed by the laws applicable in our principal place of business, without regard to conflict-of-law principles, except where mandatory consumer protections in your country require otherwise.
